This Privacy Policy explains how Relay AI LLC (“Relay,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information in connection with https://relayagents.ai/, the Relay platform, and related services. It also explains important differences between information Relay controls for its own business purposes and information Relay processes on behalf of business customers.

This Privacy Policy does not replace the privacy notice of a business that uses Relay to communicate with you or collect your information. When Relay processes personal information solely on that business’s behalf, that business is generally responsible for deciding why the information is used and for responding to privacy requests concerning that data.

  1. Scope and Our Roles

This Policy applies to personal information processed when you visit our website, create or use a Relay account, communicate directly with Relay, receive Relay’s own marketing or service communications, or interact with Relay-powered features.

Relay may act in two different roles:

• Relay as controller/business: Relay determines the purposes of processing for account administration, billing, security, fraud prevention, website operations, product analytics, customer support, legal compliance, and Relay’s own marketing.

• Relay as processor/service provider: a Relay Customer determines the purpose of processing information about its leads, prospects, customers, invitees, and other contacts, and Relay processes that information on the Customer’s behalf to provide the Services.

  1. Categories of Personal Information We Process

Depending on how Relay is used, we may process the following categories of personal information:

• Identifiers and contact information, such as name, email address, telephone number, postal or business address, account identifiers, IP address, and similar identifiers.

• Account and commercial information, such as company, job title, subscription, plan, purchases, invoices, billing contact, usage, and customer-support history.

• Lead and CRM information, such as lead source, company information, website URL, form responses, qualification answers, deal stage, appointment information, notes, tags, preferences, and relationship history.

• Communications content and metadata, such as call audio where recording is enabled, voicemail, SMS/MMS content, emails, transcripts, AI-generated summaries, call dispositions, sender and recipient identifiers, timestamps, routing, delivery status, and communication history.

• Consent and compliance records, such as consent status, disclosure shown, form or page version, source URL, checkbox or other affirmative action, date and time, IP address, user agent, seller identity, authorized channels or technologies, opt-out, revocation, complaint, wrong-number, and suppression records.

• Device, log, and online activity information, such as browser, operating system, device type, cookie identifiers, session information, pages visited, referral source, approximate location derived from IP, application events, and security logs.

• Integration data received from or transmitted to third-party applications that a Customer connects to Relay, such as calendar, email, CRM, telephony, or other application data.

• Payment and transaction information, such as payment status, transaction identifiers, and limited billing information. Full payment-card details may be collected directly by our payment processor rather than stored by Relay.

• Support and feedback information, including communications with our team, support tickets, bug reports, survey responses, and product feedback.

• Other information you or a Customer choose to submit through the Services.

  1. Sources of Personal Information

We may obtain personal information directly from you; from Relay Customers; from forms, scheduling pages, AI agents, calls, texts, and emails; from integrations authorized by Customers; automatically from websites and applications; from telecommunications and messaging providers; from payment, authentication, analytics, security, and support providers; and from lawful public or commercial sources where permitted by law.

  1. How We Use Personal Information

We may use personal information to:

• provide, operate, maintain, secure, and improve the Services;

• create and administer accounts and authorized users;

• provide CRM, lead-management, form, scheduling, workflow, AI, calling, messaging, email, transcription, analytics, and reporting functionality;

• route and deliver communications and maintain communication history;

• operate AI agents, generate responses, classify information, summarize communications, assist with scheduling, and perform Customer-configured workflows;

• process payments, invoices, subscriptions, usage, and account administration;

• provide customer support, troubleshoot problems, and communicate about the Services;

• maintain consent, suppression, opt-out, complaint, abuse, and compliance records;

• detect, investigate, and prevent fraud, abuse, security incidents, unlawful communications, and violations of our Terms;

• comply with law, court orders, regulatory requests, carrier requirements, and legal obligations;

• establish, exercise, or defend legal claims;

• measure performance and analyze usage of our website and Services;

• develop and improve features using aggregated, de-identified, statistical, and operational information;

• market Relay’s own products and services where permitted and honor marketing preferences;

• conduct corporate transactions such as financing, acquisition, reorganization, or sale of assets.

  1. Artificial Intelligence

Relay uses artificial intelligence and machine-learning technologies to provide features such as conversational agents, lead qualification, classification, routing, transcription, summarization, workflow automation, scheduling assistance, and content generation.

Information submitted to AI-enabled features may be processed by Relay and by AI infrastructure providers acting on our behalf.

Relay does not use Customer Personal Data to train, fine-tune, or validate generalized AI or machine-learning models for unrelated customers or third parties without the Customer’s express authorization.

We may use aggregated, de-identified, statistical, or operational information that does not reasonably identify an individual or Customer to operate, secure, analyze, and improve the Services.

  1. Relay-Powered Forms, Scheduling Pages and Invitee Experiences

Businesses may use Relay to create forms, lead-capture experiences, scheduling pages, AI agents, calls, texts, and other customer-facing experiences.

When you provide information through an experience associated with a particular business, the information is generally made available to that business and processed by Relay on its behalf.

The business determines why it is collecting your information, whether it will contact you, and how it will use the information. Questions about the business’s products, offers, marketing practices, or legal basis for contacting you should generally be directed to that business.

  1. Telephone Calls, SMS/MMS and Email

Relay may process call, text, email, voicemail, routing, delivery, and related metadata to provide communications services to Customers.

Where recording or transcription is enabled, Relay may process call audio, transcripts, and summaries. The Customer using the feature is responsible for determining whether notice or consent is required for its communications and recordings.

Relay may process opt-out, revocation, Do-Not-Call, complaint, and consent records to help Customers honor communication preferences, protect recipients, investigate abuse, respond to carrier or regulatory inquiries, and comply with legal obligations.

  1. SMS Privacy and Consent Information

Relay does not sell or rent mobile telephone numbers or SMS/MMS opt-in data to third parties for their own independent marketing.

Mobile information, text-messaging originator opt-in data, and consent records will not be shared with third parties or affiliates for their own marketing or promotional purposes.

We may disclose such information to service providers, telecommunications carriers, messaging providers, and other vendors as necessary to deliver messages, operate the Services, prevent fraud or abuse, comply with law, or perform the business purpose requested by the applicable Customer.

Consent to receive messages from one Relay Customer is not automatically treated as consent to receive marketing from Relay or from another unrelated Relay Customer.

  1. Cookies and Similar Technologies

We may use cookies, pixels, local storage, SDKs, and similar technologies to maintain sessions, remember preferences, secure accounts, measure website and product performance, understand usage, troubleshoot, personalize experiences, and measure or improve marketing.

Where required, we will provide choices through a cookie or privacy-preference tool.

You may control cookies through browser settings and, where available, our preference controls. Disabling certain technologies may affect functionality.

  1. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients for the purposes described in this Policy:

• Relay Customers, when information is submitted through or generated by a Customer’s use of Relay;

• cloud hosting, database, security, authentication, analytics, support, payment, AI, transcription, email, telephony, messaging, and other service providers that process information on our behalf;

• telecommunications carriers and messaging providers as necessary to transmit, route, register, secure, and troubleshoot communications;

• third-party integrations selected or authorized by a Customer;

• professional advisers, auditors, insurers, and legal counsel where reasonably necessary;

• government agencies, regulators, courts, law enforcement, or other parties where required by law or reasonably necessary to protect rights, safety, security, or the integrity of the Services;

• participants in an actual or proposed merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, subject to appropriate confidentiality protections where applicable.

  1. Sale, Sharing and Targeted Advertising

Relay does not sell Customer Personal Data for monetary consideration and does not sell mobile telephone numbers or communications consent for third parties’ independent marketing.

Relay may use analytics or advertising technologies on its public website. Depending on the technology and applicable law, certain disclosures through advertising technologies may be considered “sharing,” “targeted advertising,” or a “sale” even when no money is exchanged.

Where Relay engages in activity that is legally treated as sale, sharing, or targeted advertising and an opt-out right applies, Relay will provide an appropriate privacy-choice mechanism and honor legally required browser-based opt-out preference signals, such as Global Privacy Control, where applicable.

  1. Legal Bases for Processing Where Applicable

Where a law requires us to identify a legal basis for processing, Relay may rely on performance of a contract, legitimate interests, compliance with legal obligations, protection of legal rights and security, or consent, depending on the purpose and jurisdiction.

When Relay acts as a processor or service provider for Customer Personal Data, the Customer is responsible for determining the lawful basis for the Customer’s underlying processing.

  1. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, fulfill the purpose for which the information was collected, maintain security and fraud-prevention records, comply with contractual and legal obligations, preserve legal rights, and resolve disputes.

Retention varies by data type and context.

• Account and billing records may be retained for the active customer relationship and for applicable accounting, tax, dispute, and legal periods afterward.

• Customer Data is generally retained while the account is active and for a limited period after termination to allow export, backup rotation, support, dispute resolution, and legal compliance.

• Consent, Do-Not-Call, opt-out, telemarketing, and communications records may be retained for five years or longer where applicable law, a complaint, a legal hold, a carrier requirement, or another legitimate compliance need requires it.

• Security, fraud-prevention, and audit logs may be retained for periods reasonably necessary to detect abuse, investigate incidents, and demonstrate system integrity.

• Backups may retain copies for a limited period until overwritten in the ordinary course.

• Aggregated or de-identified information that no longer reasonably identifies a person may be retained longer.

  1. Security

Relay uses commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, and disclosure.

Measures may include access controls, encryption where appropriate, logging, authentication, vendor management, backups, and security monitoring.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

  1. Sensitive and Regulated Information

Customers should not use Relay to process information that they are legally prohibited from providing to Relay.

Customer must not use Relay to process protected health information regulated by HIPAA unless Relay has expressly agreed in writing and an appropriate Business Associate Agreement is in effect.

Customers are responsible for determining whether industry-specific laws governing health, finance, education, children, biometrics, or other regulated information apply to their use.

  1. Children

Relay is not directed to children under 13 and does not knowingly collect personal information directly from children under 13 for Relay’s own purposes.

Customers may not intentionally use Relay to collect children’s personal information in violation of applicable law.

If we learn that personal information was collected in violation of applicable child-privacy law, we will take appropriate steps to address it.

  1. Your Privacy Rights

Depending on where you live and the law that applies, you may have rights to request access to or confirmation of personal information, obtain a copy, correct inaccurate information, request deletion, request portability, opt out of certain sale, sharing, targeted advertising, or profiling, limit certain uses of sensitive personal information, withdraw consent, or appeal a decision concerning a privacy request.

You may also have the right not to receive discriminatory treatment for exercising a privacy right.

We may request information reasonably necessary to verify your identity and authority. Authorized agents may submit requests where permitted by law, subject to verification requirements.

If Relay processes the information solely on behalf of a Customer, we may direct you to that Customer or forward the request to the Customer, because the Customer generally controls the data and is responsible for responding.

  1. California Privacy Notice

If the California Consumer Privacy Act, as amended (“CCPA”), applies to Relay’s processing of your personal information, California residents may have rights including the right to know/access, correct, delete, opt out of sale or sharing, limit certain uses or disclosures of sensitive personal information, and receive nondiscriminatory treatment for exercising rights, subject to statutory exceptions.

For Relay-controlled information, the categories we may collect correspond to the categories described in Section 2, including identifiers, commercial information, internet or electronic network activity, professional or employment-related information, communications information, and inferences derived from account or product activity.

The business or commercial purposes and categories of recipients are described in Sections 4 and 10.

Relay does not sell Customer Personal Data for monetary consideration.

Where required, Relay honors recognized opt-out preference signals for sale or sharing. If Relay provides a “Your Privacy Choices” or similar control on the website, California residents may use that control in addition to contacting us at privacy@relayagents.ai.

  1. Nevada Privacy Notice

For Nevada residents, Relay provides this notice pursuant to applicable Nevada privacy law.

The categories of covered information we may collect are described in Section 2; the categories of third parties with whom information may be disclosed are described in Section 10; and this Policy describes our process for notifying users of material changes.

Where Nevada law provides a verified right to direct an operator not to make a covered “sale” of covered information, a request may be submitted to privacy@relayagents.ai.

Relay does not sell Customer Personal Data for monetary consideration as described in this Policy.

  1. Other U.S. State Privacy Laws

Residents of other U.S. states may have additional rights under applicable comprehensive privacy laws. Relay will honor verified requests to the extent required by law.

Where applicable law provides a right to appeal Relay’s decision on a privacy request, you may submit an appeal by replying to our decision or emailing privacy@relayagents.ai with “Privacy Appeal” in the subject line.

  1. International Users and Cross-Border Processing

Relay is based in the United States and may process information in the United States and other countries where Relay or its service providers operate.

Where required by applicable law, Relay will use legally recognized transfer mechanisms and safeguards for restricted international transfers.

Individuals in the EEA, United Kingdom, Switzerland, and other jurisdictions may have additional rights to access, correct, erase, restrict, object, port data, withdraw consent, and lodge a complaint with a supervisory authority.

  1. Marketing Choices

You may unsubscribe from Relay’s own marketing emails using the unsubscribe link in those emails.

For Relay’s own marketing text messages, you may use the opt-out method stated in the message.

For communications sent by a Relay Customer, use the opt-out mechanism provided or contact that Customer.

Opting out of marketing does not necessarily prevent transactional, account, security, or service communications that are otherwise permitted by law.

  1. Third-Party Websites and Services

The Services may link to or integrate with third-party websites, applications, and services. Those third parties have their own privacy practices.

Relay is not responsible for the privacy, security, or content of third-party services that Relay does not control.

  1. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to our Services, legal requirements, providers, or business practices.

We will post the updated Policy and change the effective date. If required by law, we will provide additional notice or obtain consent for material changes.
